About the event
Independent courts play an essential role in protecting people’s rights when they challenge decisions by public authorities. Judges should be able to review those decisions fairly and free from undue interference.
ODIHR is bringing together judges, legal experts and civil society representatives to help develop practical guidelines on judicial independence in administrative justice. The meeting will focus on the guidance judges need when handling cases concerning elections, peaceful assembly and freedom of association.
Building on national studies, consultations and earlier expert exchanges, participants will work through realistic case studies and identify questions the guidelines should address in everyday judicial practice.
The meeting is part of ODIHR’s Stronger Democratic Institutions in Eastern Partnership Countries project, funded by the European Union.
What the meeting will cover
Participants will discuss:
- Judicial independence in the resolution of electoral disputes
- Judicial review of restrictions on freedom of peaceful assembly
- Cases concerning freedom of association, including political parties
- Safeguards for judicial independence across these areas
Through case studies and moderated discussions, participants will consider who can bring a case, procedural deadlines, evidence, the scope of judicial review, available remedies and how judges explain their decisions.
The meeting aims to agree an outline for the guidelines, which will guide their drafting in 2027 and subsequent review in the participating countries.
Participants
The meeting is expected to bring together approximately 20–25 participants, including administrative judges and civil society practitioners from Armenia, Moldova and Ukraine, representatives of judicial councils and other judicial bodies, national and international experts, and ODIHR specialists.
Discussions will take place under the Chatham House Rule.
